ADVERTISING TERMS AND CONDITIONS

References in this document to “Onlime” includes reference to all of the companies trading under the Onlime brand depending upon the location of the services being purchased and/or accessed by you (“You”) pursuant to the terms set out in this document.

This document sets out Onlime’s (or “Our”) Advertising Terms and Conditions (the “Onlime Ad Terms”), which provide guidance on what types of advertising content you (“You”) are permitted to publish on Onlime’s social media platforms (including all ShopOnlime services), and shall include the features and services we make available, including through (a) our websites at https://onlime.com and any other branded or co-branded websites (including sub-domains, international versions, widgets, and mobile versions); (b) social plugins such as the ‘like button’, the ‘share button’ and other similar offerings; and (c) other media, brands, products, services, software (such as a toolbar), devices, or networks now existing or later developed by Onlime (each an “Onlime Social Media Platform”; collectively the “Onlime Social Media Platforms”). When You place an order to publish an advert on an Onlime Social Media Platform, each draft advert is reviewed against these Onlime Ad Terms.

1. The Ad Review Process

1.1. Before we permit an advert to be published on an Onlime Social Media Platform, it is reviewed by Onlime (or “Us”) to make sure it meets the requirements of the Onlime Ad Terms.
1.2. During the advert review process, we’ll check your advert’s images, text, target market, and positioning, in addition to the content on your advert’s landing page.
1.3. Your advert may not be approved if the landing page content is not fully functional, does not match the product/service promoted in your advert or does not fully comply with these Onlime Ad Terms.
1.4. If your advert is approved once it has been reviewed by an Onlime advertising assessor, you will receive a notification informing you that your advert has been approved, and we anticipate you’re your advert will go live within 3 working days of us providing approval (based on working days in the jurisdiction where the Onlime advertising assessor is situated.

2. Disapproved Adverts

2.1. If Your advert does not obtain necessary approval from Onlime, You will receive an email addressed to the email address associated with Your advertising account detailing the reasons why Your advert was not approved by Us.
2.2. Using the information in Your disapproval email, You can either edit Your advert to make it compliant with the Onlime Ad Terms and re-submit the revised advert, or appeal the decision to find that your original submission was contrary to the Onlime Ad Terms in accordance with the procedure below.

3. Appeal

If you are unable to edit Your ad or feel as though it was disapproved by mistake, you can appeal the decision in writing to Onlime management whose decision will be final.

4. Prohibited Content

4.1. Adverts must not:
4.1.1. violate the Onlime Ad Terms and must not, without limitation;
4.1.2. constitute, facilitate, or promote illegal products, services or activities. Adverts targeted to minors must not promote products, services, or content that are inappropriate, illegal, or unsafe, or that exploit, mislead, or exert undue pressure on the age groups targeted;
4.1.3. promote the sale or use of tobacco or related products;
4.1.4. discriminate or encourage discrimination against people based on personal attributes such as race, ethnicity, colour, national origin, religion, age, sex, sexual orientation, gender identity, family status, disability, medical or genetic condition;
4.1.5. promote the sale or use of unsafe supplements, as determined by Onlime in its sole discretion;
4.1.6. promote the sale or use of illegal, prescription, or recreational drugs;
4.1.7. promote the sale or use of weapons, ammunition, or explosives;
4.1.8. promote the sale or use of adult products or services, except for adverts for family planning and contraception, in which case such adverts must focus on the contraceptive features of the product, and not on sexual pleasure or sexual enhancement, and must be targeted to people 18 years or older;
4.1.9. contain adult content which includes nudity, depictions of people in explicit or suggestive positions, or activities that are overly suggestive or sexually provocative;
4.1.10. contain content that infringes upon or violates the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights;
4.1.11. contain shocking, disrespectful or excessively violent content;
4.1.12. contain content that asserts or implies personal attributes which includes direct or indirect assertions or implications about a person’s race, ethnic origin, religion, beliefs, age, sexual orientation or practices, gender identity, disability, medical condition (including physical or mental health), financial status, membership in a trade union, criminal record, or name;
4.1.13. contain deceptive, false, defamatory or misleading content, including deceptive claims, offers, or business practices;
4.1.14. contain content that exploits controversial political, social or religious issues for any purpose;
4.1.15. direct people to non-functional landing pages inclusive of landing pages that interfere with a person’s ability to navigate away from the page;
4.1.16. promote the sale of spy cams, mobile phone trackers or other hidden surveillance equipment;
4.1.17. imply or attempt to generate negative self-perception in order to promote diet, weight loss, or other health related products. Adverts for health, fitness or weight loss products must be targeted to people 18 years or older;
4.1.18. promote payday loans, paycheck advances or any other short-term loan intended to cover someone’s expenses until their next payday which attracts an excessively high interest rate;
4.1.19. promote business models offering quick compensation for little investment, including multilevel marketing opportunities;
4.1.20. promote penny auctions, bidding fee auctions or other similar business models;
4.1.21. promote fake documents, such as counterfeit degrees, passports or immigration papers;
4.1.22. contain content leading to external landing pages that that contain minimal original content and a majority of unrelated or low quality ad content;
4.1.23. contain spyware, malware, or any software that results in an unexpected or deceptive experience. This includes links to sites containing these products;
4.1.24. contain audio or flash animation that plays automatically without a person’s interaction or expands within an Onlime Social Media Platform after someone clicks on the advert.

5. Restricted Content

5.1. Adverts that promote or reference alcohol must comply with all applicable local laws, required or established industry codes, guidelines, licenses and approvals, and include age and country targeting criteria and applicable local laws.
5.2. Adverts for online dating services are only allowed with prior written permission from an officer of Onlime.
5.3. Adverts that promote or facilitate online real money gambling, real money games of skill or real money lotteries, including online real money casino, sports books, bingo, or poker, are only allowed with prior written permission from an officer of Onlime and providing the adverts target people 18 years or older.
5.4. Lotteries run by government entities may advertise on an Onlime Social Media Platform, provided the adverts are targeted in accordance with applicable law in the jurisdiction in which the adverts will be served and only target people in the jurisdiction in which the lottery is available.
5.5. Adverts must not promote the sale of prescription pharmaceuticals. Adverts for online and offline pharmacies are only permitted with prior written permission.
5.6. Adverts that promote acceptable dietary and herbal supplements may only target people who are at least 18 years of age.
5.7. Adverts for subscription services, or that promote products or services that include negative options, automatic renewal, free-to-pay conversion billing products, or mobile marketing are subject to our subscription services requirements.
5.8. Adverts promoting credit card applications or financial services with accredited institutions must clearly provide sufficient disclosure regarding associated fees, including APR percentages, transaction fees, within the advert’s landing page. Adverts promoting loans or insurance services must not directly request the input of a person’s financial information, including credit card information.
5.9. Adverts promoting branded content must identify the third party product, brand or business partner.
5.10. Adverts promoting student loan services must be targeted to people 18 years or older. Adverts must not promote misleading or deceptive services related to student loan consolidation, forgiveness, or refinancing.

6. Video Adverts

6.1. Video adverts and other dynamic advert types must comply with all of the rules listed in these Onlime Ad Terms, including that:
6.1.1. Videos and other similar ad types must not use overly disruptive tactics, such as flashing screens;
6.1.2. You must not use targeting options to discriminate against, harass, provoke, or disparage users or to engage in predatory advertising practices;
6.1.3. Adverts for movie trailers, TV shows, video game trailers, and other similar content intended for mature audiences are only allowed with prior written permission from an officer of Onlime, and must target people who are 18 years or older. Excessive depictions of the following content within these adverts are not allowed: drugs and alcohol use, adult content, profanity, violence and gore and targeting;
6.1.4. If you target your adverts to custom audiences, you must comply with the terms applicable to that target audience.

7. Positioning

7.1. All advertising components, including any text, images or other media, must be relevant and appropriate to the product or service being offered and the audience viewing the advert.
7.2. Adverts must clearly represent the company, product, service, or brand that is being advertised.
7.3. The products and services promoted in an advert’s text must match those promoted on the landing page, and the destination site must not offer or link to any prohibited product or service.

8. Lead Adverts

8.1. Advertisers must not create adverts which request the following types of information without Our prior written permission:
8.1.1. account numbers, including frequent flyer numbers, loyalty card numbers, or cable or telephone account numbers;
8.1.2. information regarding criminal or arrest history;
8.1.3. financial information, including bank account numbers, bank routing numbers (ABA, IBAN, BIC/SWIFT), credit or debit card numbers, credit scores, income, net worth or how much debt someone has;
8.1.4. government-issued identifiers, including social security numbers, passport numbers or driver’s licence numbers;
8.1.5. health information, including physical health, mental health, medical treatments, medical conditions or disabilities;
8.1.6. insurance information, including current insurance policy numbers;
8.1.7. information regarding political affiliation;
8.1.8. information regarding race or ethnicity;
8.1.9. information regarding religion or philosophical beliefs;
8.1.10. information regarding sexual orientation or information about the sexual life of the individual, including what gender(s) the person prefers to date;
8.1.11. information regarding Trade Union membership status;
8.1.12. usernames or passwords, including usernames and passwords for existing and new accounts.

9. Use of Our Brand Assets

9.1. Adverts must not imply endorsement or partnership of any kind by Onlime.
9.2. All other adverts and landing pages must not use Our copyrights, trademarks or any confusingly similar marks, except as expressly permitted with the prior written permission of an officer of Onlime.

10. Data Use Restrictions

10.1. Ensure any advertising data collected, received or derived from an Onlime Social Media Platform advert placed by You (“Onlime Social Media Platform Advertising Data”) is only shared with someone acting on your behalf, such as your service provider. You are responsible for ensuring your service providers protect any Onlime Social Media Platform Advertising Data or any other information obtained from us, limit their use of all of that information, and keep it confidential and secure.
10.2. Do not use Onlime Social Media Platform Advertising Data for any purpose (including retargeting, re-use of data across multiple advertisers’ campaigns, or allowing piggybacking or redirecting with tags), except on an aggregate and anonymous basis (unless authorised by the Onlime Privacy Officer) and only to assess the performance and effectiveness of your Onlime Social Media Platform advertising campaigns.
10.3. Do not use Onlime Social Media Platform Advertising Data, including the targeting criteria for your advert, to build, append to, edit, influence, or augment user profiles, including profiles associated with any mobile device identifier or other unique identifier that identifies any particular user, browser, computer or device.
10.4. Do not transfer any Onlime Social Media Platform Advertising Data (including anonymous, aggregate, or derived data) to any advertising network, advertising exchange, data broker or other advertising or monetization related service.

11. Things You Should Know

11.1. These Onlime Ad Terms apply to adverts and commercial content served by or purchased through an Onlime Social Media Platform, including adverts appearing within apps on an Onlime Social Media Platform.
11.2. You are responsible for understanding and complying with all applicable laws and regulations. Failure to comply may result in a variety of consequences, including the cancellation of adverts You have placed and termination of your account.
11.3. We do not use sensitive personal data for advert targeting. Topics You choose for targeting Your adverts do nor reflect the personal beliefs, characteristics or values of the people who use Onlime Social Media Platforms.
11.4. If You are managing adverts on behalf of other advertisers, each advertiser or client must be managed through separate advertising accounts. You must not change the advertiser or client associated with an established advertising account. You must set up a new account. You are responsible for ensuring that each advertiser complies with these Onlime Ad Terms.
11.5. We reserve the right to reject, approve or remove any advert for any reason, in our sole discretion, including adverts that negatively affect our relationship with our users or that promote content, services, or activities, contrary to our competitive position, interests, or advertising philosophy.
